Even amid the new coronavirus pandemic, Theranos’ follow-up effects continue to plague the biotech industry, media Outlet The Verge reported. Labrador Diagnostics LLC said it had two Theranos patents and sued a company that conducted COVID-19 testing for patent infringement. The lawsuit asks the court to force BioFire to stop testing.
Mark Lemley, director of science and technology programs at Stanford Law School, tweeted: “This is probably the most outrageous IP lawsuit ever filed. “
The shell company is owned by Fortress Investment Group, which bought the Theranos patent in 2018. Fortress Investment Group has previously been invested by SoftBank.
Shortly after Techdirt reported the lawsuit, Labrador Diagnostics LLC said it would allow third parties to develop COVID-19 testing using its patented technology – although it was unclear how effective the claim swashes. “Labrador wishes to make it clear that the lawsuit is not against COVID-19. The lawsuit focuses on activities that have had nothing to do with COVID-19 detection over the past six years,” the company wrote in a press release.
